Terms & Conditions

ACCOMMODATION SERVICE POLICIES, PRIVACY STATEMENT AND GENERAL RULES OF THE HOUSE.

Last update: October 21, 2025. For reservations made prior to this date, refer to the Terms & Conditions stated in your Confirmation letter.

RESERVATIONS, CANCELLATIONS AND DEPOSITS IN GUARANTEE.

These apply for DIRECT bookings only.

For reservations made with a third party Agent or channel, OTA's, refer to the T&C on their websites/confirmation letter.

  • Reservations will be guaranteed only and exclusively until the customer provides a valid method of payment and has proceeded with 100% of the payment for the service to be provided. The method of payment may be, but not limited to, Credit or Debit card, Bank transfers in Mexico or the United States of America or a different electronic method that the supplier of the service provides to the client at the moment of the booking.

 

  • In case of insufficient funds, the reservation will be canceled unless the client provides a different method to secure the payment.

 

  • If the guest needs to cancel its reservation, if it the request is within the first 48 hours of the booking, the deposit will be returned in full, if it is requested after 48 hours but within 15 days prior to the check-in date, in order to be reimbursed 100% of the deposit, a processing fee of 12% of the total amount paid for the service to be provided will be deducted. Any cancellation within the 15-day window prior to arrival will be considered non-refundable.

 

  • Reservations made within the 15-day windows stated above will be considered non-refundable, independently of the rate selected. No other policy may apply.

 

  • Changes to reservations can be made up to 15 days before the check-in and the rates will be recalculated accordingly.

 

  • Reservation changes or cancellations will be addressed via email to hola@bajahouse.co, no other communication channel will be considered for direct bookings. For third party channels, the clients will address their requests for modifications and/or cancellations through their websites accordingly.

HOUSE RULES

CHECK-IN / CHECK-OUT

 

  • The check-in time to the property will be at 3:00 p.m. and check-out time at 10:00 a.m. If a guest requires an early check-in or late check-out, the guest will address their request prior to arrival and the property reserves the right to accept or deny the request. If a guest fails to comply with the check-out time, an extra day's accommodation will be charged to the credit card on file. The regular tolerance of 15 minutes after check-out time will apply unless it is stipulated otherwise during check-in.

 

  • Each of our guests must be registered in our system to comply with local authorities and security purposes, in attention to the privacy and security of all customers all their personal information will be held strictly as confidential according to the “LEY GENERAL DE PROTECCIÓN DE DATOS PERSONALES EN POSESIÓN DE SUJETOSOBLIGADOS” which Baja House is obligated to store accordingly.

 

  • The check-out process will be conducted by one of our employees unless it is stated otherwise prior to the check-out day by the General Management’s office. The guest will leave the room’s key inside the accommodation and will lock the door assure us that all the items in the room are inside it.

 

  • Our staff will supervise the accommodation right after the customer’s departure, in case there are missing items or damage caused to Baja House’s property, the administration will document and notify the guest or guests accordingly, to remedy any damage to the furniture or property the corresponding charges to the credit card on file will be processed immediately without any prior authorization of the cardholder as he/she has accepted this policy at the time of the booking.

VISITORS

 

Baja House and/or Local Co. or any of their representatives reserve the right to admit visitors and/or occasional companions to the property, depending on the criteria of the Manager. In no case will they be allowed access to the rooms for security reasons.

 

RESPONSIBILITY

 

Baja House and/or Local Co. and its representatives will only be responsible for the values or goods of the guests that are consigned for safekeeping to the Management; therefore, they will not be responsible for the loss, damage, deterioration, damage, misplacement or such, of the values or goods not consigned.

 

Baja House and/or Local Co. or their representatives are not responsible for the partial or total loss of cars left on the street.

 

CONDUCT

 

We encourage each and every guest of Baja House to enjoy our property as if it was its own house, remembering that maybe other guests staying with us, that, as well as them, paid for a tranquil stay in Todos Santos, therefore it is implied that making uncomfortable or annoying noises, playing loud music, access and/or consume drugs, access with food for preparation in the rooms, provoke altercations, and in general, any act that bothers other are forbidden.

 

To maintain a healthy and safe ambience in Baja House, it prohibited to the guest, the following actions:

 

  • Using the rooms for acts prohibited by law or holding meetings whose main aim is disturbing public order or disobeying the laws or regulations in force.

  • Using candles, hazardous or flammable materials in rooms. In case of a room with a fireplace, the employees are the only ones that are allowed to turn it on and in case of need, they will teach the guests how to properly turn it on and off to comply with the local Civil Protection and Fire Department regulations.

If a guest does not comply with the fireplace procedure, the Manager is entitled to move the guest from that room and relocate it to a different one without any monetary compensation or explanation whatsoever.​

​

  • In accordance with the “Ley General para el control del Tabaco” it is forbidden to smoke any kind of Tobacco product inside the premises of Baja House including the outdoor areas (pool area, terraces, sunroof) and indoor areas.


The person caught doing so will be subject to a fine according to the space he/she was doing so as this causes deterioration of the facilities, particularly to the rooms. Therefore, if the personnel of Baja House identifies that the guest or guests have smoke inside the room or rooms a 100% of the cost (pretax) of the stay will be charged for additional cleaning of the room or rooms accordingly.

 

  • No pets or service animals are allowed in Baja House due to allergies and to assure comfort for other guests. Failing to comply with this Condition, Baja House and/or Local Co or its representatives reserve the right to deny the service at any time without reimbursement of the amount paid for the accommodation and in case of any damage to Baja Houses’ property it will be subject to the correspondent fine listed below.

 

  • Causing damage to Baja House’s property, building or furniture on the premises, such as walls, decoration, art, towels, linens, hot tub, kitchenware, silverware, glassware and or any other item that is not the guest’s property will generate a fine equivalent to the total cost of the damaged item.

 

  • Extact from the property items such as goods, linens, towels, robes, kitchenware, dishware, silverware and any other similar property of Baja House will incur to the payment of the total cost of the item subtracted to be charged to the credit card filed on the reservation without any prior authorization from the cardholder as he/she has accepted this policy at the moment of the booking.

 

The list of costs for the items property of Baja House is available at the Manager’s office for the guests to require it.

PRIVACY AND PERSONAL DATA STORAGE.

According to the “LEY GENERAL DE PROTECCIÓN DE DATOS PERSONALES EN POSESIÓN DE SUJETOS OBLIGADOS”, Baja House and/or Local Co. (The Company) and its representatives are obligated to maintain in strict confidentiality and not to disclose the personal information of each and every guest and/or visitor that has held ay kind of business with the company and or the property whatsoever.

 

It is mandatory for all the employees that have relations with the company to sign a confidentiality agreement to guarantee the guests’ information and privacy, therefore all the information stored on any physical or electronic device is secure and confidential.

 

The information that the company can collect to provide the service for accommodation in Todos Santos Baja California Sur México may include but it is not limited to:

 

  1. Names and surnames.

  2. ID information.

  3. Email and or postal address.

  4. Phone number, either personal or work.

  5. Date of birth, nationality and gender.

  6. Marital status and/or relationship to adults, minors or disabled clients.

  7. Profession, trade, company information or relation.

  8. Origin, destination and travel plans.

  9. Reason for the trip to Todos Santos and/or Baja California Sur.

  10. Credit or debit card, cardholder’s name, ID and postal address information. (For payment processing purposes only).

 

The information detailed above will be collected and stored from the moment of the booking and up to 7 days after the check-out of the guest. This allows the company to provide an exceptional service for the guest and collect any incidental and/or penalty charges related to the reservation.


The information gathered by the company may be requested to be modified and or deleted by no other than the guest itself. No other person will be allowed to collect, request or grant permission to view, modify or delete information regarding other person.

 

The information collected is solely and exclusively to provide the service to which the guest is paying for, failing to comply with this, the company is aware that the owner of the information will be entitled to take legal action against the company and/or its representatives accordingly.
